Alway Associates - Adjudicators
Alway Associates have vast experience as a practice dealing with Adjudication in acting as Representative for one of the parties.
In addition, a number of our senior staff are also regularly nominated and act as Adjudicator in respect of Referrals of all types and right across the industry sectors. The skills and experience that such staff have in the fields of Construction Law and disputes, and in particular Adjudication make them ideally suited to such a role.
Appointments as Adjudicator arise as a result of naming in the Contract, agreement by the parties and nomination by a number of the relevant nominating institutions including the Royal Institution of Chartered Surveyors and the Chartered Institute of Arbitrators.
Our experience is that parties to disputes where a member of our staff has acted as Adjudicator are satisfied with the treatment of the case on its merits and also the efficiency in administration and the conduct of the matter. On a number of occasions parties will agree to our staff being appointed Adjudicator in subsequent Referrals.
Alway Associates' staff act as Adjudicator in cases referred pursuant to the Housing Grants, Construction and Regeneration Act 1996 as well as those expressly provided for in particular Contracts and Sub-Contracts.
When an appointment is proposed we act quickly and efficiently in ensuring that the individual has the time to devote to the Referral and also that there is not a conflict or relationship between the individual, the practice and either Party in dispute.
In acting as Adjudicator all of our staff:
- conduct the case as an individual and give decisions which are their own and which are independent of external influences.
- treat the dispute as confidential.
- give clear directions and guidance as to the conduct of the case and timescales.
- treat each Party fairly and with respect.
- act in a manner which properly balances the need for fairness and justice with the objective of minimising time and cost.
Alway Associates' Staff who act as Adjudicator are as follows:
Lorne Alway
As a Fellow of the Royal Institution of Chartered Surveyors and Barrister and with 25 years in the industry including 15 years in Construction Law and Disputes, Lorne is well qualified to act as Adjudicator on disputes of all kinds.
He has been appointed Adjudicator on a number of occasions including being named in contracts and pursuant to the HGCR 1996.
Richard Silver
As an individual with experience and qualifications in Construction Management and Quantity Surveying, as well as being a Barrister and having acted as lead Representative in many Adjudications, Richard has all the credentials, both personally and professionally, to act as Adjudicator across the broad spectrum of disputes in the Construction Industry.
Richard is a person who is able to identify the real issues and to apply his mind fairly and efficiently to any construction problem and for the benefit of the parties in dispute.
Robert Shawyer
Robert is a registered and practicing adjudicator who also has a depth of experience representing both Referring and non-Referring parties in adjudication proceedings.
Robert’s practical experience comes from 20 years in the construction industry which combined with his Law degree and Chartered professional qualifications. Robert’s experience and qualifications make him ideally qualified to handle a wide range of contractual and commercial issues.
Robert is a panel registered Adjudicator with the CIArb, CIOB, CCS, NADR and CPHA
