Arbitration has been a mainstay of the Construction Industry for many years allowing disputes to be resolved by experienced and knowledgeable experts within the Construction and Legal worlds. In order that our clients receive the best possible advice and support Alway Associates' ensure that the most appropriate team is dedicated to assist and guide the client through the minefield that is Arbitration and achieve the best possible results.
Alway Associates' recognise that any dispute requires accurate and realistic advice that will enable a client to fully weigh up the commercial and legal considerations open to them.
We will ensure that the client is kept fully abreast of the progress of the Arbitration and will comprehensively advise on any new or emerging situation within the Arbitration process. It is our experience that such ongoing advice is desirable, if not essential, and an aspect of our service that client's value highly.
If Arbitration is unavoidable in all the circumstances and/or our clients have a settled intention to progress a matter to a formal resolution then we act as Representatives on their behalf. Each Arbitration is headed by one of our Directors or Associate Directors.
As Representatives we are able to provide our clients with a combination of services ideally suited to the process of Construction Arbitration. We have founded the practice onstaff who combine legal and construction industry qualifications and experience and it is within the framework of Arbitration that this can produce the most tangible benefits.
It allows us to relate law to facts and therefore to have a ready appreciation of the merits of a case, pertinent and cogent evidence and how the Arbitrator is likely to view the issues.
The services we provide in the Arbitration process include the following:
- providing legal advice and written opinions on all aspects of construction law, contracts and disputes
- providing advice on financial and time claims, preparing and pursuing claims including the compilation of documentation and analysis
- advising on the legal interpretation and obligations of technical specifications
- negotiating on behalf of our clients
- the provision of professional quantity surveying advice on aspects of measurement and the like
- attending preliminary and interlocutory meetings and hearings
- dealing with interlocutory issues
- co-ordinating the action and tasks to be undertaken on our clients behalf
- taking witness statements
- organising and undertaking discovery and inspection
- advising on tactics and approach
- advocacy at the hearing
It is recognised that each Arbitration is different to any other and requires individual attention to ensure the best possible results and to this end Alway Associates' will provide the most suitable person to take overall control and responsibility for that Arbitration. In the event that the disputes reaches a hearing Alway Associates' will supply one of their own highly qualified and experienced construction barristers to act.
Alternatively, and dependent on the particular requirements of the case, a specialist barrister and/or Queen's Counsel from the independent Bar can be instructed should the need arise.
Alway Associates' take pride in their ability to provide a complete Arbitration service from the first signs of a dispute and onwards should a suitable settlement not prove possible. In our experience it is of great benefit to clients to have had Alway Associates involved in the dispute from an early stage so that a clear and deep understanding of the dispute is obtained which in turn greatly assists the possibility of resolution but if that is not achievable then in the process of Arbitration itself.
