Alway Associates - Claims, Time and Money

Upon being instructed to pursue or defend time and/or money claims we undertake the following tasks as appropriate:

  • Advise on and assist in the formulation, preparation and submission of notices, applications and records.
  • Provide guidance on the heads and basis of claims including the evaluation process.
  • Preliminary investigation into the merits of the case at the outset.
  • Provide advice and written opinion on the legal and commercial support for the claim.
  • Advise on the best course of action for the earliest and most satisfactory resolution of the dispute.
  • Consider documentation and substantiation.
  • Discuss the claim with relevant members of staff.
  • Prepare documentation for use in the dispute including stating the contractual position, preparing programmes for analytical and presentational purposes, schedules, analysis of cause and effect and relevant particulars.
  • Research and deal with issues that arise during attempts to resolve the matter.
  • Undertake and advise about negotiations and tactics for the successful compromise of differences.
  • Provide advice to our clients at each stage as to the prospects for success.
  • Provide guidance on the content of claims where Adjudication or Arbitration may be necessary.
  • Advise on terms of settlement and draft appropriate agreements.

It is our experience that most time and money disputes can and should be resolved without recourse to proceedings and whenever possible that will be achieved. An essential element of our professional role is to seek to resolve the issues in a manner most favourable to our client, or at the least to be able to fully investigate the other sides case and to establish what can be achieved prior to proceedings. Against that background we are then able to provide reasoned advice setting out what further action may be taken, the risks and the timescales.

We recognise that realistic advice, based upon legal and commercial considerations provided at a very early stage to a client, and then at key points if the dispute runs on, is an essential part of the service we provide and is one that client's value highly.

Another advantage of using Alway Associates in claims situations is that, given our in -house expertise, we are able to see a dispute right through to Adjudication or Arbitration as our client's Representative if that should prove necessary. Having gained the benefit of the knowledge from the claims process itself, this allows for the cost effective management of the problem and continuity of approach.
