There are many varied International Dispute Resolution procedures, and these are often complex, and are continually developing. These procedures include;
Arbitration
Also, Alternative Dispute Resolution (ADR) procedures such as;
Mediation – a normally voluntary, non-binding, private dispute resolution process in which a neutral person helps the parties try to reach a negotiated settlement.
Adjudication – which in the UK is a Statutory procedure by which any party to a construction contract has a right to have a dispute decided (on a temporarily binding basis) normally within 28 days by an independent and impartial Adjudicator – and which is now utilised in other countries including Australia, New Zealand, Singapore, Hong Kong, and the USA (particularly in Texas and the State of New York).
Dispute Review Boards comprising of experienced, respected and impartial reviewers which are included in the World Bank’s procurement procedure and advocated by the International Chamber of Commerce together with Dispute Adjudication Boards as provided under the FIDIC Forms of Contract, Combined Dispute Boards, and Dispute Resolution Boards as promoted by the Dispute Resolution Board Foundation in the United States of America.
Whichever method of dispute resolution procedure is employed our team which includes a Chartered Arbitrator with International Arbitration qualifications, experienced adjudicators, barristers, mediators expert witnesses, planning and specialist quantity surveying staff, are able to provide the necessary support and expertise required in the field of international dispute resolution and avoidance either representing the parties or acting as part of the appropriate tribunal (i.e. Arbitrator, or Adjudicator or as a member of a Dispute Resolution/Review Board).
